Clipping Guidelines of "Pictoria”

We, Pictoria Co., Ltd. (hereinafter referred to as "the Company"), have established the following guidelines (hereinafter referred to as "these Guidelines") to ensure a safe and secure process for creating "clips" of videos published by creators (hereinafter referred to as "affiliated streamers") under our company.
We appreciate your understanding and cooperation to help our content reach a wider audience.
Definition of "Clips"
In these Guidelines, "clips" refer to the process of dividing, combining, editing, and adding audio or textual elements to one or more videos (hereinafter referred to as "original videos") published by the Company or affiliated streamers for the purpose of online publication. "Clipped videos" refer to the new videos created through this process intended for publication.
Permission for Clipped Videos
The Company grants permission to create and publish clipped videos that comply with these Guidelines.
Affiliated Streamers Eligible for Permission of Clipped Videos:
The following affiliated streamers are eligible for permission to create clipped videos:
- Towa Kiseki
- Tsumugi Nen
- Shindo Shirube
- Yumemi Yurame
- AILENE
- MAILENE
- Tsukiyono Aruma
- Asahina Raira
- Hayami Nao
Eligible Videos for Permission
The eligible videos for permission to create clipped videos (hereinafter referred to as "eligible videos") shall be the videos publicly released from the channels of affiliated streamers of the Company on the following video-sharing platforms (excluding deleted videos): YouTube (excluding short videos). The distinction between live broadcasts and limited releases is not relevant. However, videos designated as "unavailable" by the Company or affiliated streamers are excluded.
Prohibited Actions for Clipped Video Production
The following actions are prohibited when attempting to create clipped videos:
- Intentionally altering the intended expression or purpose of the original video to create misleading content.
- Combining eligible videos with other videos (including those created by oneself or third parties) that are not eligible.
- Engaging in text modifications or other edits that damage the reputation and credibility of the Company or affiliated streamers or insult their character.
- Adding text or audio that presents false, unverified information or lacks confirmation of its factual accuracy.
- Engaging in edits that infringe upon the copyrights, portrait rights, or other rights of third parties.
- Creating clipped videos to advertise and promote third-party names, products, or services.
- Expressing content that violates laws or public order and morality.
- Any other actions deemed inappropriate.
Publication of Clipped Videos
The publication of clipped videos shall be conducted by uploading them to the following video-sharing platforms. However, only YouTube allows the generation of revenue from clipped videos.

Monetization
For clipped videos to be eligible for monetization, in addition to adhering to the "Prohibited Actions for Clipped Video Production" mentioned above, it is necessary to comply with the terms of use of the respective video-sharing platforms, any relevant terms of use specified by third-party content rights holders in the original videos, and other related agreements. This includes utilizing advertising revenue, including revenue generated through partner programs and creator programs offered by video-sharing sites such as YouTube.
- Please note that registration of the automatic identification function as one's own copyrighted material, including Content ID registration, is prohibited.
Cautions for Publication
Prior confirmation of clipped videos by the Company is not required. However, immediate compliance is mandatory if the Company instructs re-editing or removing published clipped videos. In such cases, the Company isn't obligated to explain the given instruction.
When uploading clipped videos on YouTube, it is required to clearly indicate "Clipped" in the channel name, account name, or video title.
When uploading clipped videos on YouTube, the description section should include a URL linking to the channel or video from which the clip was made.
For SNS platforms included in the publication targets, such as X, if the clipped video is published without using a dedicated account for clipped videos, it is not necessary to explicitly mention that it is a clipped video. However, behavior that may mislead viewers into thinking it is the original content of the poster is strictly prohibited.
- Clipped videos published before November 30, 2022, which fall under the scope of these rules, can remain public unless otherwise specified by the Company.
Character Visuals and Logo Usage Guidelines
When using character visuals and logos in icons, thumbnails, or within videos, please strictly adhere to the following guidelines:
<Character Visuals>
- Changing the colors, aspect ratio, or flipping is not allowed.
- Excessive alterations are not allowed.
- Using the character visuals in a way that may lead to misidentification as the Company or affiliated streamers is not allowed. (In case character visuals are used, it should be clearly indicated in the icon that it is a clipped video.)
<Logo>
- Usage of the logo in icons is not allowed.
- Any modifications to the logo are strictly prohibited.
- Overlaying text or images on top of the logo is not allowed.
- Additionally, immediate compliance with any re-editing or removal instructions from the Company is mandatory.
Etc.
If any complaints or claims for damages are received from third parties due to the clipped videos, the creator of the clipped videos is responsible for resolving the issue at their own discretion.
When using materials for which third parties hold rights in the clipped videos, it is the responsibility of the creator of the clipped videos to obtain permission for the use of such materials.
If a violation of this guideline is acknowledged by the Company, the Company may request the immediate removal of the violating channel, account, or video and the creator of the clipped video should not raise any objections. Furthermore, the creator of the clipped video shall compensate the Company for any damages incurred.
This guideline may be revised or abolished by the Company at any time at its sole discretion. The revised content shall take effect upon publication on this website.
Q&A
Q: Is it permissible to create clipped videos of live broadcasts by Pictoria before the video editing and publication?
A: Even before the videos are published by the Company, it is allowed to create clipped videos. However, editing and publishing them as a single planned video similar to the videos published by the Company is prohibited.
However, it is permissible to create compilation videos or videos as part of a single planned concept when it is explicitly mentioned that they will not be made into videos.
Q: Is it permissible to create clipped videos of content featuring streamers other than those affiliated with Pictoria?
A: Regarding streamers other than the affiliated streamers of the Company, the Company does not have the right to grant permission for clipped videos.
Q: Is it permissible to create and publish original videos supporting Pictoria within the clipped video channels?
A: While the general rule is limited to clipped videos, there is no prohibition against the production and publication of original videos that support Pictoria's content and purpose.
Q: Is it permissible to create clipped videos featuring Pictoria staff appearing in live broadcasts or videos by Pictoria-affiliated streamers?
A: Clipped videos of staff members appearing in videos in their capacity as staff members of the Company are allowed to be created and published alongside the affiliated streamers.
Q: Is it permissible to create clipped videos of former Pictoria-affiliated streamers' activities?
A: Clipped videos of former Pictoria-affiliated streamers are prohibited. The prohibitions and restrictions mentioned in this guideline shall apply.
Q: Is it permissible for minors to create clipped videos?
A: It is allowed to create clipped videos regardless of age. However, for the YouTube Partner Program, there is an age restriction requiring participants to be 18 years or older to use AdSense. Furthermore, according to the AdSense eligibility requirements, if the individual is under 18 years old, a guardian can use their Google account to apply for AdSense.

Q: I mainly create clipped videos of streamers other than those affiliated with Pictoria, but is it permissible to create clipped videos of collaborations between those streamers and Pictoria-affiliated streamers?
A: As long as you adhere to this guideline, even if you operate a clipped video channel focused on other streamers, you are allowed to create clipped videos that include Pictoria-affiliated streamers. However, please follow the monetization policies of the main streamer featured in the video.
Q: Is it permissible to create derivative works using the posts related to singing activities (cover songs, singing livestreams, etc.) by Pictoria-affiliated streamers?
A: It is not permissible to obtain permission from the Company as it would infringe upon the rights of the Pictoria-affiliated streamers and third parties who hold the rights to the audio sources.\
- The Japanese version of these Guidelines shall be the official version hereof, and these Guidelines shall always be construed on the basis of the Japanese only. Translations into other languages shall be used solely for reference, and in the event of a discrepancy between the Japanese version of these Guidelines and a translation hereof, the Japanese version shall prevail.
